alleged attacks by the assailants duly armed under a conspiracy and
nor the recent attacks at Government Hospital Kotkpura and on the
contrary he is constantly receiving threatening.
Sir,
It is requested that the applicant Naresh Kumar Sehgal, resident is
doing business for earn his bread and butter and is doing press-
reporting as his curricular activity. Besides this being a religious
leader every year a big religious festival Dushehra and cultural
programme is organized in the whole city under the chairmanship of the
applicant in which there remains gathering of about 60-70 thousand and
similarly Akhand Jot Jhanda Shobha Yatra Mela, Maa Jwala Himachal
Pradesh to Kotkapura on road is organized and the religious diwans and
Vishal Jagrans are organized. In this religious programme being
organized under the chairmanship of the applicant, thousands of people
participate in the programme. Besides a religious Sehgal Bhajan Mandli
which organizes Jagran, Chowkies, Sankirtan and Akhand Ramayan etc.,
absolutely free. Hence some anti-social elements keep jealous and
enmity without any reason with the above press report keeping in view
his increasing respect, because our organisation has no link or
concern with any political party. Ours is a religious and social
organisation.
That for the last many years the applicant had been attacked upon many
times from time to time and the record of which is available at Police
Station Kotkapura. Many cases for the attampts to murder have been
registered against the assailants for committing attacks upon the
applicant. Many cases are under consideration in the Hon'ble Courts
and regarding some cases the police have not released the Challan to
Court.
Under the orders of the Hon'ble Punjab and Haryana High Court various
FIRs have been registered against the accused persons for attempt to
murder and other conspiracies, snatchings etc., in which an FIR No.
129 dated 30.6.2006, Police Station City Kotkapura against Sukhbir
Singh Badal, Deputy Chief Minister, Punjab son of Parkash Singh Badal,
Chief Minister, Punjab and others is registered. Regarding which the
case is under consideration of the Hon'ble Court. Similarly FIR No. 93
year 2002 under offence of attempt to murder and other is also
registered at Police Station City and the cases are pending in the
court. Similarly many other cases in which the assailants attacked
upon the applicant, are pending in the various courts. Keeping in view
the Hon'ble Punjab and Haryana High Court in writ petition No. 75729
of 2007 directed the DGP Punjab and ADGP Punjab and IG Bathinda
provided one Gypsy official alongwith driver and one ASI, two
Havaldar, Two Constable of Punjab police to the applicant as security
since the year 2006 and the said security was withdrawn without
assigning any reason in the year 2007 during the regime of Akali
Bhapka Government on the directions of Sukhbir Singh Badal.
That the applicant was attacked upon many times in which Sukhbir Singh
Badal personally is involved. Similarly on 26.12.2010 at about 3:30
when the applicant was passing through on his scooter before the shop
of Raunki and before the Girls Hostel in the street Romi Kapoor son of
Sardari Lal Kapoor alongwith some other person who was being called as
Natkhat, having a thin body, small height, Sardar who could be
recognised if comes again, both of them stopped me and gave blows of
clenched fists. They were having a bundle of keys in their hand and
was abusing using illicit language. They al threatened to kill me.
Their exceess were being seen by the shopkeepers of the area. The
accused are having their houses in the same locality. Hence none tried
to rescue him. The applicant ran away from there and escaped his live.
They from his mobile phone he tried to contact SHO Gurjit Singh
Romana, Police Station, Kotkapura. Told him about Romy Kapoor and the
attacked and he asked the applicant to come to the police station and
disconnected the phone. In the eventuality of not expecting any
assistance from the police and finding himself in more danger he
reached the Government Hospital Kotkapura for the treatment of the
injuries. On the way he also apprised the police officials performing
their duty at Battian Wala Chowk, Kotkapura.
At the Government Hospital Kotkapura, Dr. Manjit Singh Takkar and
other administering the treatment and sent an MLR No. MST/125 dated
26.12.2010 describing the injuries as Sharp and others and also
recommended X-rays and after obtaining my signature sent the same to
the police station, Kotkapura at about 4:00 PM for further necessary
action in which the 4/5 injuries described were on the left cheek,
outside the left hand, left side of the neck and backside the head
etc.,
Later on the applicant the SSP Faridkot, DSP Kotkapura, Munshi Police
Station City, Kotkapura on telephone No. 01639-251080 and 01635-220468
and other numbers but none of the police official reached to help the
applicant neither on the spot and nor at the Government Hospital,
Kotkapura.
The applicant Naresh Kumar Sehgal through his personal phone intimated
many other police officers and local police station and police
officers of the district including Punjab level and DGP Police
Officers and apprised them about the above alleged occurrence.
Earlier also the above assailants stopped me on 23/24 December on the
say while going to the DSP Kotkapura, opposite the doctor's shop in
front of rehri of Ashoke Bhaturian Wala, and abused me using the
illicit language. Beside the above persons the rehri pullers are the
witnesses. There was another person with Romy Kapoor who could be
recognised if appeared again before me who is reported to be a
resident of the Jaiton area. Thin body, Sikh, using turban. On the
spot Romy Kapoor called some Dhillon named person on his mobile and
asked him to bring persons at the rehri of Ashoki Bhature Wala. Today
we have to teach lesson to Mr. Sehgal.
Applicant Naresh Sehgal called on telephone No. 97795-87505, the SHO
Gurjit Singh Romana and further he replied that we are busy in a
meeting with the S.S.P. Sahib. Talk again. Then on telephone No.
01639-252000 the SSP office was contacted. The operator was apprised.
He said that SSP Gurmit Singh Randhawa is conducting a meeting. You
may call back later on. Similarly at the instance of Gunman Lovely
posted with the S.H.O. and in his presence, the day when the DC
Faridkot had distributed sweaters in Gandhi School, Faridkot, Mantar
Singh Brar Ex-MLA was also present there. This function was organized
from 11 to 1:00 PM but about 12:00 hours noon, Romy Kapoor present
there having Camera in his hand abused in the presence of Lovely
Gunman. Instead of stopping him or initiating any proceedings the
police officials accompanied with Lovely kept silence and went aside.
Regarding which also the information was conveyed to the police
station on telephone No. 01635-220468 and other police officials were
also contacted but none of them picked the phone. At that time SHO
Gurjit Singh Ramana was not there. The police vehicle was however
parked before the gate of the school. I, finding myself in danger,
left the function and came back.
Similarly on 8.12.10 the applicant was attacked upon. The injuries
were inflicted and I was admitted in the Kotkapura Hospital, where the
Doctor obtained my signature on an MLR HSG/26/10 dated 8.12.10 at
about 10:00 AM and sent the same to the police station Kotkapura in
which the detail of injuries was given as on the left cheeks near
ears, near cheeks under the ear, below the neck, on the skull of head
on right hand side etc., Later on at 1:00 PM ASI Kashmir Singh
Havaldar, Harphul Singh etc., came to the Government hospital to
record my statement after 30 hours of the above alleged occurrence to
whom I have a statement that I want to get my statement in the
presence of some Gazetted Officer. In this attack the police and Civil
Officers in connivance with each other have a fatal attack upon me. I
will give my statement to the S.D.M. DM, Duty Magistrate because in
this alleged occurrence many Police officials are also involved. In
case if I get my statement recorded in the hospital, then there was
possibility that I could be killed in the hospital. I have danger to
my life in the Hospital. Hence an immediate proceedings be initiated
to get my statement recorded through Duty Magistrate or SDM level
officer. I have serious injury in my head. Hence the FIR of this
statement may be registered and the Duty Magistrate SDM may be called.
On 8.12.10 at about 9:30 AM I was attacked upon in front of Girls
School by two persons. In case of any sort of delay the concerned
police officer will be responsible. The statement recorded, heard,
which is true and correct.
This much statement was recorded with the police. Later on many other
police officers were contacted on telephone for many times and 3/4
time they were contacted through the mobile phone of others but no
proceedings were initiated. Gurjit Singh Romana, SHO Kotkapura, DSP
Dilbag Singh Pannu, Kotkapura, SSP, Gurmit Singh Randhawa, Faridkot
and MHC Harpal Singh, AMHC Baljit Singh, Ranjit Singh all police
station, Kotkapura and apart from them the District Officers, DIG
Ferozepur, IG Bathinda and DGP Punjab Chandigarh and other officers
were also phoned. On 8.12.2010 in the evening at about 7:00 PM Gurjit
Romana, SHO and Sub Inspector Bachittar Singh and other officers
employees reached Government Hospital, Kotkapura and said that No Duty
Magistrate or Officer, SDM is present at this time. You may get your
statement recorded. We will take action right now. I (Naresh Kumar
Sehgal, Applicant) got my statement recorded to the above officers
which was recorded by Bachitar Singh in the presence of Gurjit Singh.
But Neither the blood stained clothes, hand-kerchief were then into
their possession and nor any assurance was given regarding my security
and nor a certified copy of my statement was given to me and nor the
statement was read over to me. I put my signature under pressure. What
action was taken, I have not been apprised till date and nor I have
received any intimation. After 8.12.10 next day a function was
organized in front of OPD of the Government Hospital Kotkapura – Prize
Distribution Function. I was admitted in the hospital. I was in my
room. This function was organized from 10 to 12 hours. Where besides
the Civil Surgeon Faridkot Shri Bharti, Shri Mantar Singh Brar, Ex-
MLA, Kotkapura and BJP and Akali Dal Badal worker, Romy Kapoor was
also remained there for two or two and a half hours. Later on on
seeing me Ajit Lal Mehta and Romy Kapoor came to my bed in Emergency
ward and threatened me saying be ready for consequences. Regarding
which SHO Gurjit Singh Romana Police Station Kotkapura DSP Dilbagh
Singh Pannu and SSP Gurmit Singh Randhawa alongwith others were
apprised. They were wandering in the hospital in a car till late
night. But none of the police official took any action after hearing
me. Earlier the ASI Kashmir Singh and Sub Inspector Bachittar Singh
had recorded my statements in the hospital. But regarding this
incident, regarding threatening and openly wandering of the accused
assailants in the hospital, no statement was recorded. On calling by
telephone time and again the only reply was received that we are just
coming to the hospital. The above telephones was called through my
phone No. 98146-99799. Some phone calls were made through the phones
of the patients admitted in the hospital.
It is clear that the assailant Romy Kapoor is in connivance with the
political persons and the is also in connivance with the police
officers. In connivance with the earlier SHO Gursher Singh and DSP
Bikram Singh and at the instance of them and other political leaders
Sukhbir Singh Badal Deputy Chief Minister, Punjab, the said attacks
took place in which Romy Kapoor and terrorists of Babbar Khalsa Group
were involved regarding which I have already given my statement and
since no FIR was registered by the police, a writ petition has been
filed in the Hon'ble Punjab and Haryana High Court. Similarly for
getting the CRP security and getting the whole incident investigated
from the CBI and other matters cases etc., the writ petition which is
pending in the High Court. The above assailant Romy Kapoor is known by
another name to mislead and cheat the people who is working in the
electricity board on contract basis and receives the cash of data
operator and issues receipts. But he is openly wandering and his
presence is marked. Hence this person can do anything at any time in
connivance with the police and the terrorists. He is having full
support of the police and the political persons. This is the reason
that till date no case has been registered against him.
On 26.10.2010 regarding attack an MLR MST 125/10 was sent to the
police station in the evening at about 4/5 PM in which the injuries
were report sharp and others. But till night upto 8 PM no police
officer recorded my statement. On the contrary in the Emergency ward
when I was lying on the bed, three persons duly armed with weapons
having a Carbine Sten-gun and the other armed with sharped edged
weapons entered in the Emergency room of the Government Hospital,
Kotkapura. In the first room there are 4/5 bed and after that crossing
the verandah there were 4 beds out of which on one bed I was lying
where at gun point Surinder Kapur son of Sardari Lal Kapur, brother of
Romy Kapur stood and his other companioned picked me from the neck who
was having yellow turban, who can be recognised if appeared again,
fair colour, age about 25/30 years and on opposing they gave blows on
my mouth left and right chest with the butt of the weapons. There was
blood and blood on the floor, chadar of the bed, my jacket, shirt,
undergarments were blood stained. I raised an alarm of 'Maar ta Maar
ta, save me' but they took me sweeping from one room to the other room
where beds of the patients were lying. The ladies and men present
there also raised an alarm and the staff of the Government Hospital
arrived there and on seeing them the assailants giving blows ray away
from there alongwith their respective weapons in a car which was
already parked in start condition.
During this attack in the General Ward of the Government Hospital, the
Ex-MLA Mantar Singh Brar, Ex MLA and other persons had come to know
the welfare of some other patients. On the spot Kaur Singh Havaldar
was present in the hospital. On the spot the whole incident was
described to the doctor and he wrote the same and obtained my
signature and released another MLR No. MST/130 dated 26.12.10 at about
8:30 PM and sent to the police station, Kotkapura for necessary action
and again the injuries inflicted as sharp and described the full
details.
Munsih/SHO to SP, SSP DIG IG DGP Punjab all were contacted on
telephone but none of the police official came to record my statement.
Only Gurjit Singh Romana, SHO and Bachittar Singh and Kaur Chand
Havaldar and other police officials checked the injuries and conducted
investigation from the surrounding people. Again during the night of
26 and 27 they came again. SHO Gurjit Singh, Sub Inspector Bachittar
Singh and Bhupinder Singh Havaldar threatened to leave from the
hospital and to put signature on the blank papers. But I have not put
my signature and they left from there. In this regards also the police
officers were apprised that they have threatened that a case will be
registered against me.
On 27.12.2010 at 11:40 Gurjit Singh Romana Sub Inspector Bachittar
Singh and other police officers came to Government Hospital Kotkapura.
Since there was no light in the Emergency ward they put pressure upon
me and asked me to get the statement recorded outside in the park.
Where I went in very slow speed and gotmy statement recorded. They
declined to take the blood stained clothes into the custody of the
police and also denied to obtain the blood marks from the hospital
saying we will see again. It was also a pre-planned conspiracy. I was
attacked upon with weapons with the intention to be kidnapped from the
Government Hospital. No action has been taken against the accused,
involvement of the police officers, local District administration and
at the instance of political persons the antisocial elements inflicted
injuries to me at the instance of police and above political persons.
Action may be taken against them immediately. An FIR of the entire
matter may be registered as per law and a certified copy may be
provided to me (Naresh Kumar Sehgal) and the investigation of the case
may be got conducted from the CBI. The security of mine and my family
may be ensured and I may be provided security apart from the Punjab
Police like CRP etc., The above accused persons can kill me any time
so that the earlier FIRs could be dismissed and to escape Sukhbir
Singh Badal, it is a preplan conspiracy.
An FIR against the above accused persons may be registered
immediately and the security keeping aside the Punjab police may
kindly be ensured from some other security agency or CRPF. No action
as been taken against the statements recorded till date and nor any
certified copy has been provided to me. I shall be very thankful to
you.

statement may be registered and the Duty Magistrate SDM may be called.
On 8.12.10 at about 9:30 AM I was attacked upon in front of Girls
School by two persons. In case of any sort of delay the concerned
police officer will be responsible. The statement recorded, heard,
which is true and correct.
This much statement was recorded with the police. Later on many other
police officers were contacted on telephone for many times and 3/4
time they were contacted through the mobile phone of others but no
proceedings were initiated. Gurjit Singh Romana, SHO Kotkapura, DSP
Dilbag Singh Pannu, Kotkapura, SSP, Gurmit Singh Randhawa, Faridkot
and MHC Harpal Singh, AMHC Baljit Singh, Ranjit Singh all police
station, Kotkapura and apart from them the District Officers, DIG
Ferozepur, IG Bathinda and DGP Punjab Chandigarh and other officers
were also phoned. On 8.12.2010 in the evening at about 7:00 PM Gurjit
Romana, SHO and Sub Inspector Bachittar Singh and other officers
employees reached Government Hospital, Kotkapura and said that No Duty
Magistrate or Officer, SDM is present at this time. You may get your
statement recorded. We will take action right now. I (Naresh Kumar
Sehgal, Applicant) got my statement recorded to the above officers
which was recorded by Bachitar Singh in the presence of Gurjit Singh.
But Neither the blood stained clothes, hand-kerchief were then into
their possession and nor any assurance was given regarding my security
and nor a certified copy of my statement was given to me and nor the
statement was read over to me. I put my signature under pressure. What
action was taken, I have not been apprised till date and nor I have
received any intimation. After 8.12.10 next day a function was
organized in front of OPD of the Government Hospital Kotkapura – Prize
Distribution Function. I was admitted in the hospital. I was in my
room. This function was organized from 10 to 12 hours. Where besides
the Civil Surgeon Faridkot Shri Bharti, Shri Mantar Singh Brar, Ex-
MLA, Kotkapura and BJP and Akali Dal Badal worker, Romy Kapoor was
also remained there for two or two and a half hours. Later on on
seeing me Ajit Lal Mehta and Romy Kapoor came to my bed in Emergency
ward and threatened me saying be ready for consequences. Regarding
which SHO Gurjit Singh Romana Police Station Kotkapura DSP Dilbagh
Singh Pannu and SSP Gurmit Singh Randhawa alongwith others were
apprised. They were wandering in the hospital in a car till late
night. But none of the police official took any action after hearing
me. Earlier the ASI Kashmir Singh and Sub Inspector Bachittar Singh
had recorded my statements in the hospital. But regarding this
incident, regarding threatening and openly wandering of the accused
assailants in the hospital, no statement was recorded. On calling by
telephone time and again the only reply was received that we are just
coming to the hospital. The above telephones was called through my
phone No. 98146-99799. Some phone calls were made through the phones
of the patients admitted in the hospital.
It is clear that the assailant Romy Kapoor is in connivance with the
political persons and the is also in connivance with the police
officers. In connivance with the earlier SHO Gursher Singh and DSP
Bikram Singh and at the instance of them and other political leaders
Sukhbir Singh Badal Deputy Chief Minister, Punjab, the said attacks
took place in which Romy Kapoor and terrorists of Babbar Khalsa Group
were involved regarding which I have already given my statement and
since no FIR was registered by the police, a writ petition has been
filed in the Hon'ble Punjab and Haryana High Court. Similarly for
getting the CRP security and getting the whole incident investigated
from the CBI and other matters cases etc., the writ petition which is
pending in the High Court. The above assailant Romy Kapoor is known by
another name to mislead and cheat the people who is working in the
electricity board on contract basis and receives the cash of data
operator and issues receipts. But he is openly wandering and his
presence is marked. Hence this person can do anything at any time in
connivance with the police and the terrorists. He is having full
support of the police and the political persons. This is the reason
that till date no case has been registered against him.
On 26.10.2010 regarding attack an MLR MST 125/10 was sent to the
police station in the evening at about 4/5 PM in which the injuries
were report sharp and others. But till night upto 8 PM no police
officer recorded my statement. On the contrary in the Emergency ward
when I was lying on the bed, three persons duly armed with weapons
having a Carbine Sten-gun and the other armed with sharped edged
weapons entered in the Emergency room of the Government Hospital,
Kotkapura. In the first room there are 4/5 bed and after that crossing
the verandah there were 4 beds out of which on one bed I was lying
where at gun point Surinder Kapur son of Sardari Lal Kapur, brother of
Romy Kapur stood and his other companioned picked me from the neck who
was having yellow turban, who can be recognised if appeared again,
fair colour, age about 25/30 years and on opposing they gave blows on
my mouth left and right chest with the butt of the weapons. There was
blood and blood on the floor, chadar of the bed, my jacket, shirt,
undergarments were blood stained. I raised an alarm of 'Maar ta Maar
ta, save me' but they took me sweeping from one room to the other room
where beds of the patients were lying. The ladies and men present
there also raised an alarm and the staff of the Government Hospital
arrived there and on seeing them the assailants giving blows ray away
from there alongwith their respective weapons in a car which was
already parked in start condition.
During this attack in the General Ward of the Government Hospital, the
Ex-MLA Mantar Singh Brar, Ex MLA and other persons had come to know
the welfare of some other patients. On the spot Kaur Singh Havaldar
was present in the hospital. On the spot the whole incident was
described to the doctor and he wrote the same and obtained my
signature and released another MLR No. MST/130 dated 26.12.10 at about
8:30 PM and sent to the police station, Kotkapura for necessary action
and again the injuries inflicted as sharp and described the full
details.
Munsih/SHO to SP, SSP DIG IG DGP Punjab all were contacted on
telephone but none of the police official came to record my statement.
Only Gurjit Singh Romana, SHO and Bachittar Singh and Kaur Chand
Havaldar and other police officials checked the injuries and conducted
investigation from the surrounding people. Again during the night of
26 and 27 they came again. SHO Gurjit Singh, Sub Inspector Bachittar
Singh and Bhupinder Singh Havaldar threatened to leave from the
hospital and to put signature on the blank papers. But I have not put
my signature and they left from there. In this regards also the police
officers were apprised that they have threatened that a case will be
registered against me.
On 27.12.2010 at 11:40 Gurjit Singh Romana Sub Inspector Bachittar
Singh and other police officers came to Government Hospital Kotkapura.
Since there was no light in the Emergency ward they put pressure upon
me and asked me to get the statement recorded outside in the park.
Where I went in very slow speed and gotmy statement recorded. They
declined to take the blood stained clothes into the custody of the
police and also denied to obtain the blood marks from the hospital
saying we will see again. It was also a pre-planned conspiracy. I was
attacked upon with weapons with the intention to be kidnapped from the
Government Hospital. No action has been taken against the accused,
involvement of the police officers, local District administration and
at the instance of political persons the antisocial elements inflicted
injuries to me at the instance of police and above political persons.
Action may be taken against them immediately. An FIR of the entire
matter may be registered as per law and a certified copy may be
provided to me (Naresh Kumar Sehgal) and the investigation of the case
may be got conducted from the CBI. The security of mine and my family
may be ensured and I may be provided security apart from the Punjab
Police like CRP etc., The above accused persons can kill me any time
so that the earlier FIRs could be dismissed and to escape Sukhbir
Singh Badal, it is a preplan conspiracy.
An FIR against the above accused persons may be registered
immediately and the security keeping aside the Punjab police may
kindly be ensured from some other security agency or CRPF. No action
as been taken against the statements recorded till date and nor any
certified copy has been provided to me. I shall be very thankful to
you.
